£8 Million Payout for ‘Deficient’ Post-Natal Care

Lawyers representing a seven-year-old boy who was stricken by catastrophic brain damage after his hospital birth have achieved an £8 million settlement of his case – and a public NHS apology for the deficiencies in his post-natal care.

The youngster, who cannot walk or speak, was left with profound lifelong cerebral palsy after medics mishandled desperate attempts to resuscitate him following his delivery in 2006. Nottingham Hospitals NHS Trust acknowledged that mistakes had been made and said that steps had been taken to avoid their recurrence.

Although the boy was able to smile and respond to his large family, he would need a team of carers to look after him constantly and suffered from acute learning difficulties. The judge approved the settlement as ‘just and appropriate’ and said, "He is really lucky to have a family like this. I wish them all well."

The settlement agreed by the Trust, which admitted full liability for the boy’s injuries, took the form of a £3.25 million lump sum, plus annual, index-linked and tax-free payments to cover the costs of his care for life. Those payments would start at £146,500, rising to £230,000 when the boy reaches the age of 19. The total package was valued at more than £8 million.
