Driver Who Could Not Avoid Crash Not Liable

When a 14-year-old cyclist brought a claim against the driver who hit him and rendered him tetraplegic, a substantial settlement may have been foreseen, despite the fact that the driver was uninsured.

However, the evidence showed that the driver was keeping well within the speed limit and paying proper attention to the road. The court concluded that he had no reasonable prospect of avoiding the collision once the child had pulled out

The driver was therefore not liable for the cyclist’s injuries.
