Kidney Transplant Boy Wins Almost £5 Million Damages

A 10-year-old boy who suffered kidney failure after he was born with a condition which was negligently managed at a private hospital has won a compensation package worth almost £5 million to pay for the lifetime of care he will need.

The boy was born with a congenital birth defect affecting his bowel and he required a colostomy. Due to a series of errors by medical staff, he suffered acute renal failure and needed dialysis from the age of six months. He also had a kidney transplant after his father agreed to donate one of his organs.

His condition will blight the rest of his life and he will require another kidney transplant at some time in the future. He has already undergone 28 surgical procedures during 149 days in hospital. Despite all that, he was described as an ‘enthusiastic, optimistic and very sociable’ boy who was doing well at school.

The boy’s lawyers launched proceedings against the hospital and three medical staff who were involved in his care. Breach of duty was admitted and defence lawyers issued an ‘unreserved apology’ on their clients’ behalf. The boy’s case was settled at the High Court for a total of £4,825,000 to compensate him for, amongst other things, his pain and suffering, lost future earnings and the ongoing costs of his care.
