New research shows less than half of Employment Tribunal Claimants paid in full

Claimants in Employment Tribunals missing out?

The Government Department for Business, Innovation and Skills have recently published a report showing how many Employment Tribunal awards are actually paid to Claimants. The report itself can be found here:

Summary

For those of you who don’t feel like wading through the statistics, here is a quick summary:

  • Only 49% of claimants received their Tribunal award in full in 2013
    This is down from 53% in 2008. 66% of claimants received at least some payment.
  • Only 53% of claimants received some payment without having to take further legal action
    If an employer can’t or won’t pay, many Claimants have had to resort to further legal action to recover their award.
  • 61% of Claimants received some payment without further legal action, if they were assisted by lawyers
    There are many possible reasons for this, but having a solicitor ready to take furtherlegal action if necessarycan prompt many employers make payment.
  • Of the reasons for non-payment, 25% of claims were not paid due to insolvency of the employer.
    This was the biggest reason for non-payment and it is very important for Claimants to take the correct steps to recover as much of their award as possible. Insolvency always presents a problem but the Government do guarantee some payments to Claimants and it is vitally important to take early advice.
