We are sure you have seen the television adverts in the past advertising personal injury claims on a “no win no fee” and “100% compensation”. But, you may now be wondering why this has disappeared? What’s changed? Can you still claim?
In April 2013 the Government introduced the Legal Aid, Sentencing and Punishment of Offenders Act. The result and impact on the personal injury industry has meant that anybody wanting to make a personal injury claim would have to pay towards their Solicitors legal costs. Something that was not necessary before.
There has been much confusion to many people as to whether or not they can still claim. The simple answer is yes! However, all clients must pay a success fee and also any insurance policy (if purchased) if their claim is successful. This will be a maximum of 25% of the compensation you receive. So, if you were to be awarded £10,000 for your accident, up to £2,500 would be payable to your Solicitors for their success fee; their fee for successfully winning your claim. So even though you have to contribute towards the legal costs, you are still in a winning position.
