Changes to No Win No Fee from April 1st 2013

We are all are used to seeing solicitors offering ‘no win no fee’ arrangements.  Those arrangements will still be offered but the way in which they operate will change from 1 April 2013. 

All Solicitors and insurance companies have previously been working on the principle that if successful, the legal costs associated with the claim would be paid for by the other side and you keep 100% of your compensation.

However from April 2013 if you make a successful claim you may find that up to 25% of the damages awarded to you are used as payment for legal fees.

The Government is of the view that there are too many fraudulent personal injury claims being made and are making the changes to stop this. However, this means that people like you, who are involved in accident through no fault of your own, are being prevented from claiming the full amount of compensation you are entitled to as Solicitors are limited in those fees recovered from the other side and you are unable to recover any After the Event Insurance or solicitor’s success fee from the other side.
