Government defers increases to small claims threshold

The Government has been taking steps to reduce not only the number, but the value of Personal Injury claims and as part of this had planned to increase the upper limit of small claims from £1,000 to £5,000, with a massive impact to compensation entitlements to those involved in road traffic accidents...

On 30 April 2010 the way in which personal injury claims following road traffic collisions changed. This is now changing again.

Changes to No Win No Fee from April 1st 2013

 

All Solicitors and insurance companies have previously been working on the principle that if successful, the legal costs associated with the claim would be paid for by the other side and you keep 100% of your compensation.

However from April 2013 if you make a successful claim you may find that up to 25% of the damages awarded to you are used as payment for legal fees.

The Court of Appeal has just delivered a judgment in the case of Sims v Dacorum Borough Council which considered the question of whether a joint tenant (i.e. one of two tenants named in a tenancy agreement) could themselves serve notice terminating a tenancy agreement.
